March 8th Update on california Homeschool situation

March 8, 2008

Many of you have heard about the recent court ruling in California. Below is the statement issued by AFHE (Arizona Families for Home Education) earlier today.

PRAY: Please pray for homeschooling families in California and in particular the leaders of the California state homeschool organizations, HSLDA staff, and others who are pouring a lot of time and energy into this researching and responding to this issue. Pray for energy, health, peace, wisdom, discernment, and strength. Most of the leaders involved are homeschooling parents themselves who tirelessly serve the homeschool community in addition to teaching their own children at home.

SUPPORT THE PARENTAL RIGHTS AMENDMENT: In addition to prayer, you can encourage your friends and family - homeschoolers and non-homeschoolers alike - to support the Parental Rights Amendment. Go to www.parentalrights.org. The California court ruling is a prime example of the urgent need to get this amendment passed and also to stay vigilant concerning our freedom to teach our children at home. Your support of state organizations like AFHE and national organizations like HSLDA is crucial and much appreciated as we actively work to promote private home education and protect parents' rights to homeschool.

NOTE: For those of you that are not aware, in addition to running HERO, James and I serve on the board of directors for AFHE so we are directly involved at both a local level and state level in serving Arizona homeschooling families. We will be sure to keep HERO subscribers informed. The HSLDA web site will be the best place to get up-to-date information about this case. We encourage you to check there regularly.

Keep resting in Him!

Joyfully,
Nancy Manos
AFHE Statement re: California Court Ruling
March 8, 2008

As you might be aware, a California Court of Appeals case involving a homeschooling family has gained national attention because the ruling, if left unchanged, would make it illegal to homeschool unless performed by a tutor certified to teach in California. This would effectively eliminate the vast majority of parent-led home teaching. It would make homeschooling nearly impossible at the secondary level because to teach a high school curriculum the tutor would have to be certified in every subject area. The Home School Legal Defense Association (HSLDA) was not aware of this case before the decision of the three-judge appellate court was published on February 28, 2008. HSLDA is mounting a response, and you can go to their website at www.hslda.org for more information.
Please visit the HSLDA web site to sign a Petition to Support Homeschool Freedom in California.
You might wonder what ramifications this may have to homeschooling in Arizona. California's courts do not determine the law in Arizona. Our right to homeschool as a legal, alternative way of meeting the compulsory education requirements of the State of Arizona is found in A.R.S. §15-802. The term "home school" is defined by statute and the practice is recognized by that name. Therefore, we are distinct in this regard from California where homeschooling has been allowed in practice under their private school statute. AFHE has always encouraged Arizona parents to carefully monitor their rights and freedoms. Our laws are made by our state legislature, and can be changed. This is why AFHE has built a reputation over the past 25 years of having a presence at the legislature in the form of a lobbyist and allied ourselves with other pro-family organizations who aid us in keeping ahead of proposed legislation that might affect our ability to homeschool.
AFHE will watch the developments in the California case closely, and we encourage our membership to do the same. Dr. James Dobson dedicated his program on Friday March 7, 2008 to this topic and we encourage you to go to the Focus on the Family website at www.family.org and listen to the broadcast. We join in his call to pray for this situation. The case that prompted the ruling is atypical of the majority of homeschooling families and presents some serious legal issues because of a 20 year history of contact with the child welfare system on the part of the family involved. But the broader question is whether one family's problems should impact the personal liberty and educational choice of everyone else through the vehicle of a court decision? We want to believe that those charged with leadership -both at the Supreme Court of California and the California legislature---can and will see the difference.

Please Take a Moment to do this poll.

Bill Roach, President of CHEC (Christian Home Educators of Colorado), has asked us to spread the word about a poll that 9NEWS in Colorado is doing today. I have voted and encourage you to take a moment to vote as well.

The poll question asks "Do you think parents or guardians who homeschool their children should be required to have teaching credentials to do so?"

Bill Roach says, "Often times things make their way to Colorado from California. Some are good, and some are not so good. Right now our major news station here in Denver, 9NEWS.com, is having a poll on whether or not folks think that homeschooling parents should have proper teaching credentials to homeschool their children. In the light of what has happened in California, I think things like this will gain some traction if we don't move quickly and decisively. Would you consider taking a few seconds and help your fellow homeschoolers in Colorado? You probably will be helping your state as well in the mean time. These polls only last for a few hours and then they are gone. We would like to overwhelm them with "no" votes. Thanks for your help!"

Go to www.9NEWS.com - the poll is on the right side about half way down the page.
Thank you!

Judge orders homeschoolers into government educationCourt: Family's religious beliefs 'no evidence' of 1st Amendment violation
Posted: February 29, 20083:24 pm Eastern
By Bob Unruh© 2008 WorldNetDaily
A California court has ruled that several children in one homeschool family must be enrolled in a public school or "legally qualified" private school, and must attend, sending ripples of shock into the nation's homeschooling advocates as the family reviews its options for appeal.
The ruling came in a case brought against Phillip and Mary Long over the education being provided to two of their eight children. They are considering an appeal to the state Supreme Court, because they have homeschooled all of their children, the oldest now 29, because of various anti-Christian influences in California's public schools.
The decision from the 2nd Appellate Court in Los Angeles granted a special petition brought by lawyers appointed to represent the two youngest children after the family's homeschooling was brought to the attention of child advocates."We find no reason to strike down the Legislature's evaluation of what constitutes an adequate education scheme sufficient to promote the 'general diffusion of knowledge and intelligence,'" the court said in the case. "We agree … 'the educational program of the State of California was designed to promote the general welfare of all the people and was not designed to accommodate the personal ideas of any individual in the field of education.'"
The words echo the ideas of officials from Germany, where homeschooling has been outlawed since 1938 under a law adopted when Adolf Hitler decided he wanted the state, and no one else, to control the minds of the nation's youth.
Wolfgang Drautz, consul general for the Federal Republic of Germany, has said "school teaches not only knowledge but also social conduct, encourages dialogue among people of different beliefs and cultures, and helps students to become responsible citizens."
Specifically, the appeals court said, the trial court had found that "keeping the children at home deprived them of situations where (1) they could interact with people outside the family, (2) there are people who could provide help if something is amiss in the children's lives, and (3) they could develop emotionally in a broader world than the parents' 'cloistered' setting."
The appeals ruling said California law requires "persons between the ages of six and 18" to be in school, "the public full-time day school," with exemptions being allowed for those in a "private full-time day school" or those "instructed by a tutor who holds a valid state teaching credential for the grade being taught."
The judges ruled in the case involving the Longs the family failed to demonstrate "that mother has a teaching credential such that the children can be said to be receiving an education from a credentialed tutor," and that their involvement and supervision by Sunland Christian School's independent study programs was of no value.
Nor did the family's religious beliefs matter to the court.
Their "sincerely held religious beliefs" are "not the quality of evidence that permits us to say that application of California's compulsory public school education law to them violates their First Amendment rights."
"Such sparse representations are too easily asserted by any parent who wishes to homeschool his or her child," the court concluded.
The father, Phillip Long, said the family is working on ways to appeal to the state Supreme Court, because he won't allow the pro-homosexual, pro-bisexual, pro-transgender agenda of California's public schools, on which WND previously has reported, to indoctrinate his children.
"We just don't want them teaching our children," he told WND. "They teach things that are totally contrary to what we believe. They put questions in our children's minds we don't feel they're ready for.
"When they are much more mature, they can deal with these issues, alternative lifestyles, and such, or whether they came from primordial slop. At the present time it's my job to teach them the correct way of thinking," he said.
"We're going to appeal. We have to. I don't want to put my children in a public school system that teaches ideologies I don't believe in," he said.
A spokesman for the Home School Legal Defense Association, one of the world's premiere homeschooling advocacy organizations, said the group's experts were analyzing the impact of the decision.
"It's a very unfortunate decision," he said.
Randy Thomasson, of Campaign for Children and Families, said under California law parents have the legal right to create a private school in their home and enroll their own children.
"Children belong to the parents, not to the state," he said. But he acknowledged that there's a great deal of misinformation about the status of homeschooling in California.
"For years the government school establishment has been lying to parents about the law. Just this week, a Los Angeles Unified school district employee lied to a mother who wanted to homeschool, telling her you must have a license, you must be credentialed and you must follow all the state curriculum. That's three lies in one sentence."
"Now we have judges going crazy and actively separating children from their parents."
A legal outline for parents' homeschool rights in California, published by Family Protection Ministries, confirmed Thomasson's description.
The state's legal options for home educators include establishing a private school in their home by filing a private school affidavit with state regulators or enrolling in private school satellite instruction programs or independent study programs, it said.
The Long family had been involved in such a program with Sunland Christian School, but the appeals court took the extraordinary step of banning the family from being involved in that organization any longer, since it was "willing to participate in the deprivation of the children's right to a legal education."
A number of groups already have assembled in California under the Rescue Your Child slogan to encourage parents to withdraw their children from the state's public school system.
It's because the California Legislature and Gov. Arnold Schwarzenegger worked together to establish Senate Bill 777 and Assembly Bill 394 as law, plans that institutionalize the promotion of homosexuality, bisexuality, transgenderism and other alternative lifestyle choices.
"First, [California] law allowed public schools to voluntarily promote homosexuality, bisexuality and transsexuality. Then, the law required public schools to accept homosexual, bisexual and transsexual teachers as role models for impressionable children. Now, the law has been changed to effectively require the positive portrayal of homosexuality, bisexuality and transsexuality to 6 million children in California government-controlled schools," said Thomasson.
Even insiders joined in the call for an abandonment of California's public districts. Veteran public school teacher Nadine Williams of Torrance said the sexual indoctrination laws have motivated her to keep her grandchildren out of the very public schools she used to support.
The Discover Christian Schools website reports getting thousands of hits daily from parents and others seeking information about alternatives to California's public schools.
WND reported leaders of the campaign called California Exodus say they hope to encourage parents of 600,000 children to withdraw them from the public districts this year.
The new law itself technically bans in any school texts, events, class or activities any discriminatory bias against those who have chosen alternative sexual lifestyles, said Meredith Turney, legislative liaison for Capitol Resource Institute.
There are no similar protections for students with traditional or conservative lifestyles and beliefs, however. Offenders will face the wrath of the state Department of Education, up to and including lawsuits.
"SB 777 will result in reverse discrimination against students with religious and traditional family values. These students have lost their voice as the direct result of Gov. Schwarzenegger's unbelievable decision. The terms 'mom and dad' or 'husband and wife' could promote discrimination against homosexuals if a same-sex couple is not also featured," she said.
Karen England, chief of CRI, told WND that the law is not a list of banned words, including "mom" and "dad." But she said the requirement is that the law bans discriminatory bias and the effect will be to ban such terminology.
"Having 'mom' and 'dad' promotes a discriminatory bias. You have to either get rid of 'mom' and 'dad' or include everything when talking about [parental issues]," she said. "They [promoters of sexual alternative lifestyles] do consider that discriminatory."
The California plan still is facing a court challenge on its constitutionality and a possible vote of the people of California if an initiative effort succeeds.

This is disturbing

If your child's school observes the homosexual sponsored "Day of Silence," keep your child at home April 25.

Dear Angela,
Friday, April 25, several thousand schools across the nation will be observing "Day of Silence (DOS)." DOS is a nationwide push to promote the homosexual lifestyle in public schools. AFA is joining other family-oriented groups in urging parents to keep their children at home that day if their local school is participating in the DOS project. By remaining silent, the intent of the pro-homosexual students is to disrupt the classes while promoting the homosexual lifestyle. DOS is sponsored by an activist homosexual group, the Gay, Lesbian and Straight Education Network (GLSEN). DOS leads the students to believe that every person who identifies as a homosexual, bisexual or cross-dresser is a victim of ongoing, unrelenting harassment and hate. Students are taught that homosexuality is a worthy lifestyle, homosexuality has few or no risks, and individuals are born homosexual and cannot change. Those who oppose such teaching are characterized as ignorant and hateful bigots. Click here for Frequently Asked Questions about the Day of Silence:
Take Action!
What should parents do? Check with your local school principal to see if your child's school will be participating in DOS. If the school is participating, notify other parents about DOS and ask them to join in keeping their children out of school on that day. Here is a partial list of schools which are expected to participate in DOS: If your school is listed, call your local school and ascertain whether they officially or passively allow students to observe "Day of Silence." If your school is listed, please double-check with your local school to see if the school is actually sponsoring DOS. Sometimes the "participation" turns out to be a handful of kids who are saying they have a homosexual club and are observing this protest day, but without school endorsement. We sincerely hope your school, if listed, is not actually an official sponsor. If it is not, we will take them off the list, if a school official asks us to do so. Please e-mail your correction to editor@missionamerica.com. Some tips:
Be sure of the date that DOS is planned for your school. (The national date is April 25, but some schools observe DOS on a different date.)
Inform the school of your intention to keep your child home on that date and explain why. Click here for a sample letter.
Explain to your children why you're taking a stand: Homosexual behavior is not an innate identity; it is a sinful, unnatural and destructive behavior. No school should advance a physically, emotionally, and spiritually destructive sexual lifestyle to students.
Encourage your church leadership to follow the bold example of Pastor Ken Hutcherson who is vocally opposing "Day of Silence" in his community in Redmond, Washington. For his story, click here.

That is an email I received today and I find this so disturbing. What makes me so upset about it is.. well ALOT OF REASONS.. One in particular is the fact that we*christians* can not voice our oppinion on ANY subject because that would be intrusive on others rights regarding speration of CHURCH/STATE. So than can someone please explain to me or our CHILDREN why everyone BUT US get to say what they like at any given time and are able to express themselves under the FREEDOM OF SPEECH amendment??? hmmm.... yes I know and agree with that is what this world has come to.. but do we sit by and just let it happen??? Everyone knows I homeschool. but this still affects all of us REGARDLESS of how you school your children.. I am getting so sick of standing by and letting this stuff go on.. I am only one voice and believe me I use it often and well.. WE ALL need to stand up and start DOING SOMTHING about OUR RIGHTS as well.. THe right to serve the GOD who made this world..PUBLICLY WITHOUT APOLOGY... THe right to marry (if your a woman) the man whom GOD has chosen for you. or ( if your a man) the woman GOD has chosen for you. The right to stand against ALL KINDS OF MURDER including ABORTION without being called a HATEFUL person... The right to open up THE BIBLE without being escorted to the BOSS or principal.. We as christians have in some way caused our own dilema... by being the kind of people who do not FORCE ourselves or BELIEFS on anyone.. but this is a differant day and age in which we live and now we MUST be forceful if we expect to SALVAGE any of our rights for our children.... I do not have all the answeres but I just want to do SOMETHING to stand up for what is right.. There is NOTHING HOLY and sacred left in this world today I KNOW.. but there COULD STILL BE if we all UNITED to protect our rights.. How?? by starting in the town/city that you live in .. GET INVOLVED... if your at break and something is said.. DO NOT be afraid to say how you feel in a nice way but stand up for what is right.. dont be intimidated by thinking.. oo this might get me in trouble or ooo that might offend someone.. Hey I am offended by you being GAY.. I am offended by you killing your baby.. I AM offended by you watching porn at work or anywhere that I HAVE TO HEAR ABOUT IT>.. THIS is my world to and if you can not take hearing about MY JESUS but want me to hear about UR BUDAh or PORN or LOVER.. I DON'T THINK SO.. that aint goin down like that.. You can bet on that..

SHEW OK taking a breath.. O man I get so frustrated.. UGH... so anyway I just wanted to post that article so those of you who care enough to get involved will have a place to start.. Google AFA action alert and you will find alot of good resources to use..

GOD BLESS EACH AND EVERY ONE OF YOU AND GOD BLESS THE USA!!

I had to take a TEST and I was so nervous before I could enroll and I thought for sure I would BOMB it..lol.. Well I did so well and above normal that they basically BEGGED me to go on into the nursing program. See I have tried for well ever to get my RN but it was always something both good and bad that always seemed to interrupt thus why I gave up and decided to wait till it was the RIGHT time. I am so glad that I did all my pre-req's though because now I can go straight into the actual program and not spend all my time in Biology or psych, or English, or HCC, or blah blah blah..lol.. SOOO I am excited that it may finally be TIME to accomplish what my heart has longed for my whole life(besides being a mother and wife) I am sad on one hand as I love being home with my kids all the time.. but least they will have their dad.. See Steve and I believe so deeply in not leaving our kids with ANYONE that we have only done it a few times and didn't last for long as we were just not comfortable with the situation.. So my awesome husband is going to take over the bulk of homeschooling( I will most deff be involved of course) and we are heading into new beginnings :) SO I start my class May19th(unless a spot opens up sooner) Than I will prob Begin the RN program this fall... lol I have taken so many of these classes before but that will only help me do a better job this time around.. The girls are totally excited about mama doing this so that makes me feel good... YEA AAA ... so that is a bit on what I have been up to this past week sense our path changed courses..
